E-2 Treaty Investor Visa

The E-2 is a non-immigrant visa that allows nationals of treaty countries to live and work in the US by investing in a US business. There is no fixed minimum investment, but $100,000+ is recommended for most businesses, with $60,000-100,000 often accepted for service-based businesses.

Turkey is Eligible

Turkey has an E-2 treaty with the United States. This is a significant advantage as many EU countries (including Germany, France, and the Netherlands) do NOT have E-2 treaties. Turkish entrepreneurs can directly apply for E-2 status.

Key Requirements

Must own or control at least 50% of the US business. Investment must be "substantial" relative to the business type. Funds must be at risk and irrevocably committed. The business must not be marginal (must generate more than just a living for the investor).

Family Benefits

Spouse receives Employment Authorization Document (EAD) and can work for any US employer. Children can attend US schools. Visa is renewable indefinitely in 2-5 year increments as long as the business remains operational.

Important: The E-2 does NOT provide a direct path to a green card. However, many E-2 holders later transition to EB-5 or employer-sponsored green cards while maintaining E-2 status. It is a powerful "live and work in the US now" solution while building a longer-term immigration strategy.

EB-5 Immigrant Investor: Direct Path to Green Card

The EB-5 program is the only US immigration pathway that provides a direct route to permanent residency through investment alone. No education, language, business experience, or employer sponsorship required.

TEA Investment

$800,000

Targeted Employment Area (rural or high unemployment)

Standard Investment

$1,050,000

Any US location

Job Creation Requirement

Must create at least 10 full-time US jobs. For Regional Center projects (most common), indirect and induced jobs count. Direct investment requires 10 direct employees.

Green Card Process

2-year conditional green card issued first. After 2 years, file to remove conditions. Then eligible for permanent green card. Full family included: spouse and unmarried children under 21. Processing: 12-36 months (rural TEA projects often faster).

Visa Backlog Warning: Citizens of China, India, and Vietnam face significant visa backlogs of 8-12+ years due to per-country limits. Turkish citizens currently do NOT face a backlog, making this an advantageous window.

Green Card Lottery (Diversity Visa Program)

The DV Lottery is a free annual program that awards approximately 55,000 permanent resident visas through random selection. It is the only way to get a US green card without investment, employer sponsorship, or family ties.

Turkey is Eligible

Turkish citizens are eligible for the DV Lottery. Requirements are minimal: high school diploma or 2 years of qualifying work experience in a field requiring at least 2 years of training. Random selection means no investment or special qualifications needed.

How It Works

Apply online at dvprogram.state.gov during October-November each year. Results announced the following May. If selected, you proceed with immigrant visa processing (12-18 months). Spouse and unmarried children under 21 are included. Apply every year to maximize your chances.

Grenada + E-2 Combo: The Back Door Strategy

Citizens of countries without a US E-2 treaty have an alternative route: first obtain Grenada citizenship through investment, then apply for a US E-2 visa as a Grenadian citizen. Grenada is the only Caribbean CBI program with a US E-2 treaty.

Step 1

Grenada CBI

$235,000

Contribution to National Transformation Fund. 4-6 months processing.

Step 2

US E-2 Visa

$60-100K+

Invest in US business as Grenadian citizen. 2-6 months processing.

Total estimated cost: $295,000-$370,000+ (Grenada CBI + US business investment + legal fees). Timeline: 8-14 months for Grenada citizenship, then 2-6 months for E-2 visa. This strategy is popular among Chinese, Indian, and Middle Eastern entrepreneurs who lack E-2 treaty access through their home country.

Note for Turkish citizens: Since Turkey already has an E-2 treaty with the US, this Grenada combo strategy is NOT necessary for Turkish nationals. It is relevant for citizens of countries without E-2 treaties who want US access.

Frequently Asked Questions

Can Turkish citizens get a US E-2 Visa?

Yes. Turkey has an E-2 treaty with the United States. Investment of $100,000+ is recommended. Many EU countries do NOT have this treaty, giving Turkish nationals a unique advantage.

What is the minimum EB-5 investment?

$800,000 in a Targeted Employment Area (TEA) or $1,050,000 for standard investment. Must create 10 full-time US jobs. No education or language requirements.

Is the DV Lottery really free?

Yes, there is no fee to apply for the Diversity Visa Lottery. Apply at dvprogram.state.gov during October-November. Beware of scam websites that charge fees.

Does the E-2 lead to a green card?

Not directly. The E-2 is a non-immigrant visa renewable indefinitely. However, many E-2 holders later transition to EB-5 or employer-sponsored green cards while maintaining E-2 status.

What is the Grenada + E-2 combo?

Citizens of non-treaty countries can obtain Grenada citizenship ($235K CBI), then apply for a US E-2 visa as a Grenadian citizen. Not necessary for Turkish citizens who already have E-2 treaty access.

What is the Trump Gold Card?

$1,000,000 non-refundable gift + $15,000 processing fee per person. Results in EB-1/EB-2 green card (permanent residency). Each family member costs additional $1M + $15K. Corporate route: $2M per employee. This is NOT an investment — it's a donation that doesn't come back. Official site: trumpcard.gov.

Gold Card vs EB-5: which is better?

Gold Card: $1M donation (gone forever), faster processing. EB-5: $800K-$1.05M investment that comes back after ~5 years, but requires 10 job creation. If you want your capital back, EB-5. If speed matters more than capital preservation, Gold Card. Note: Gold Card is brand new (2026) and may face legal challenges.

Trump Gold Card: The New $1M Green Card Path

Introduced in 2026, the Trump Gold Card is a new pathway to US permanent residency. Unlike the EB-5, this is not an investment — it is a non-refundable gift/donation to the US government. The money does not come back.

Non-refundable gift + $15K processing

Corporate Route

How It Works

  • Pay $1,000,000 non-refundable gift + $15,000 processing fee per person
  • Each family member requires an additional $1M + $15K
  • Corporate route: $2,000,000 per employee
  • Results in EB-1/EB-2 category green card (permanent residency)
  • Official site: trumpcard.gov

Critical: This Is NOT an Investment

Unlike EB-5, the Gold Card payment is a gift/donation that does not come back. With EB-5, your $800K-$1.05M is an investment that is returned after approximately 5 years. With the Gold Card, the $1M is gone permanently. This is the key difference prospective applicants must understand.

Important disclaimer: The Trump Gold Card program is very new (2026) and may face legal challenges. Immigration policy in the US can change rapidly between administrations. Verify all details at trumpcard.gov before making any decisions.
