Portugal: EU Residency via Golden Visa, 2026 Citizenship Law Update

The real estate route is closed. The NHR tax regime is gone. And as of May 2026, the 5-year citizenship path is also closed: Lei Organica n.o 1/2026 raised naturalization to 10 years for most investors (7 years for EU and CPLP nationals). Permanent residency (a separate status) remains at 5 years.

Law Change: Citizenship Timeline Extended (May 19, 2026)

Lei Organica n.o 1/2026 raised Portugal's naturalization requirement from 5 years to 10 years for most non-EU/non-CPLP nationals, and 7 years for EU citizens and CPLP nationals (e.g. Brazilians, Angolans). Golden Visa holders are not exempt. Permanent residency (not citizenship) still requires 5 years and was not changed. Applications filed before May 19, 2026 keep the old 5-year rule under transitional provisions.

Key detail: Fund must be registered with CMVM (Portuguese Securities Commission), invest at least 60% of capital in Portuguese companies or real estate, and have a minimum 5-year commitment. Choose your fund manager carefully — this is a long-term relationship.

Citizenship Requirements (Year 10 for most, Year 7 for EU/CPLP)

  • 10 years of legal residence for most nationalities; 7 years for EU and CPLP nationals (changed by Lei Organica n.o 1/2026, May 19, 2026)
  • A2 level Portuguese language proficiency
  • Clean criminal record
  • Connection to Portugal (7 days/year minimum stay satisfies this)
  • No renunciation of existing citizenship required (Portugal allows dual citizenship)

Tax Regime: NHR Discontinued, IFICI Limited

Important: NHR Is Gone

The Non-Habitual Resident (NHR) tax regime, which offered a flat 20% income tax rate and tax exemptions on foreign income for 10 years, was discontinued for new applicants in 2024. If you see websites still promoting NHR, they are outdated.

IFICI: The Limited Successor

The Incentive for Scientific Research and Innovation (IFICI) program replaced NHR but is significantly more restrictive. It offers a 20% flat tax rate for 10 years, but only for:

  • University professors and scientific researchers
  • Qualified professionals in technology and innovation
  • Senior management in companies with significant investment
  • Professionals in specific sectors defined by government decree

Most passive investors and retirees will not qualify for IFICI. Plan your tax strategy accordingly.
